Extract from a resolution received from the Generalitat:

 

In accordance with article 58 of the Law 30/92 concerning jurisdiction over administration and procedures in communities, we inform you that dating 18 June 2007, the Director General of  Ports and Airports, by virtue of article 6.3 of law 5/1998 concerning Catalan ports has issued the following resolution:

   Dated 28 Sep 2005 the society:  “presented a request for authorization of works for a construction project for a maritime installation called Port Canadell, to be situated at the far end of the main canal called Rio Grande in the urbanization of Santa Margarita…

            The plots concerned in the project are at present privately owned, but will pass into public ownership once the project is approved…………….producing a leisure marina of about 20,000 square meters.  The installation will provide a draft of between 2 – 3 meters and on walkways and jetties of prefabricated wood it will offer moorings with water, power and telephone lines for 325 boats.

 

            The Director of Ports resolves”\: To authorize the Society to carry out the works  etc etc….

 

Further addressing the Residents Association of Santa Margarida , the Generalitat says it must specify in respect of the resolution:

  1. As far as the Generalitat is concerned there is no Rio Grau, since it has been converted into a canal called Rio Grande.  (This means the law of the Coast can be applied, contrary to the opinion of the Residents).
  2. The present moorings attaching to private properties will be taken into public ownership.
  3. The Generalitat rejects the proposition that the Law of Coasts does not apply to inland waterways.
